My buddy and I are both in shape and we hike a lot. Recently we stopped to bate together and mutually masturbate by a gorgeous waterfall. We were off the trail, but this couple came by and saw us doing it. The man just grinned and gave us a thumbs up, but the woman looked upset and pulled him away. Could we get in trouble for this???

RESPONSE:

Unfortunately, you can get in legal trouble for indecent exposure or public lewdness in the USA, and in most parts of the world, if you are seen masturbating in what is considered a public place. This seems totally unreasonable to those of us who love to see men’s penises, male erections, and love to witness men masturbating. But until the laws become more reasonable, be aware there is that danger.

Most likely in the situation you describe the couple who spotted you and your buddy bating by the falls, simply had different attitudes due to their sexes. Probably they would not feel inclined to try to report your behavior or get you into trouble, but who knows? The man, like many men, maybe thought it was funny or even looked fun. If the woman had not been with him, possibly he would have wanted to join you and bate with you two, if you were willing to let him join.

The woman, on the other hand, apparently either found the sight offensive, or even more likely, just somewhat embarrassing and a bit confusing. Many women don’t seem to understand how powerfully men are driven to want to experience raw physical penis pleasure for its own sake. This is certainly not to suggest that human females have less intense sexual passion or drives. Still, the reality is that the desires of women do tend to take somewhat different paths and forms than those of men. She may also have felt slightly threatened if she has any sense that the man with her was at all interested in your activities. His attitude may have influenced her reaction.

Unfortunately, there is the legal issue. As irrational as it seems to those of us with sex-positive and nudity-positive attitudes, and relaxed or even actively approving attitudes towards masturbation, this can be serious. I have written several columns in the past concerning the legal ramifications of public nudity, genital exposure, and being seen masturbating. In one case I responded to a young man caught by a security video masturbating on a bus late at night; the other was a fellow who liked the “thrill” of masturbating in the shrubbery of Central Park in NYC.

Sadly, you can get an actual prison term or a considerable fine in the worst-case scenarios. Quite often if you are luckier, you may end up being assigned mandatory community service and/or counseling.

Part of the issue is that apparently plenty of people are still shocked or offended by the unexpected and unasked-for sight of naked, aroused, masturbating men. To me personally, a more reasonable reaction seems to be curiosity and happy appreciation, or even feeling aroused and possibly wanting to join in the activity.

Be aware that many people might not feel as I do. Also, sadly, the laws are still rather absurd on these issues! Be aware.
